The GameStop hate train just keeps on rolling. Looks like a Mr. James Collins is suing the game retail giant over “deceptively misleading” practices. You can check out the full story linked below if you wish, but what it boils down to is a case of, “The box said I would get free DLC! I didn’t! I’m going to sue!”
The catalyst for this suit is when the plaintiff purchased a used copy of Dragon Age back in January that advertised a free DLC code. Of course with a used copy, the previous owner had already redeemed the code making it worthless. The plaintiff goes on to say,
“GameStop, who makes more than 20% of its revenue and nearly $2 billion from the sale of used video games, is aware of this issue, and continues to fail to alert customers that this content is not available on used games. As a result, GameStop tricks consumers into paying more for a used game than they would if they purchased the same game and content new.”
How do you feel about this case? Do you feel that the plaintiff has a legal chance of winning? How about his morals? It is very important to note that the GameStop’s return policy fully permitted him to return the game within a seven day period. If the DLC was THAT important to him, wouldn’t he have returned it within that period?
Personal Opinion (Feel free to ignore):
I really wish people would back the shit off of GameStop. Sure they have us by the balls and exploit the crap out of that. But if you don’t like it, DO NOT SHOP THERE! There are plenty of other places to purchase games. I fully believe that GameStop needs to inform customers about this problem…but a full on lawsuit over some $15 DLC? Get a figgin life. Plus, we may not have to worry about GS for too much longer. With how popular digital distribution is getting, and GS’s refusal to accept it, brick and mortar game buying is getting less and less feasible every day.

I think gamestop/ebgames do have us by the balls.. but hey that’s business.. you cant expect to a business not to want to make the largest profits as possible right? they are certainly not a charity… last time I checked anyhow.
EXACTLY! The biggest blow you could deal to GameStop is not shop there. DONE! That was easy.
I personally do not have a problem with them. Like you said, they exploit the consumer. But they still put money in the economy and supply jobs.
He might have a case surprisingly enough. I would agree that if you don’t like gamestop, don’t shop there; but the game sales business is a oligopoly. There really isn’t many video game sellers. So I’m in favor of bitching about gamestop.
As per the actual article though.. I think the Moron who bought a used game should have expected that the previous owner had used the free DLC
.. but if they advertised that it came with a DLC code then he will probably win.. but how much can he possibly get? maybe a class action would be better in this case.

Frivolous law suits like this are one of the major problems with this country. But what is worse, is that they WIN THEM! The judge’s really need to look at them and say, “Really? Over $10? Man up you pussy! Get a life! If you want to bitch, that is your God given right. But a law suit for $10? You’re a fucktard.”
Anything that gives Gamestop a royal kick up the arse is more than welcome. Thing is, not everyone fully understands DLC, and there’s no guarantee that the code has actually been used.
